Authority to Approve the Sale, Trade-In, or Transfer of Surplus Property and to Allocate Proceeds

I. Delegation Summary
Delegated To: Vice Chancellor--Business and Administrative Services
Scope of Delegation: This authority applies to (1) determining
the method of disposition of surplus property, (2) if materiel is to be sold,
allocating the proceeds from the sale, (3) if materiel is to be sold, selling
the materiel to UC employees or near relatives, or, (4) donating the excess
materiel to educational institutions, other governmental bodies, or non-profit
organizations. Excluded from this
delegation are transfers of federally funded, University-owned goods to be
transferred to other educational institutions, governmental bodies, or
non-profit organizations.

II. Detailed Delegation
It is inevitable that certain materiel and equipment owned by the University will become obsolete or excess to the unit’s or University’s needs. University property, which is released, must be in excess of current and projected needs of the unit. Once declared surplus by the unit head/principal investigator, in accordance with Business and Finance Bulletins A-51 and BUS-38, effective immediately, the Vice Chancellor--Business and Administrative Services is authorized to dispose of excess equipment as follows:
1. Method of sale: to determine the method of disposal, e.g., approve the sale, trade-in, or transfer. This authority may be delegated to the Director, Materiel Management.
2. Allocation of Proceeds (if material is to be sold): to allocate the net proceeds to the account of the unit releasing the property. This authority may be delegated to the Director, Materiel Management.
3. Selling to a UC employee or near relative: to approve the sale of surplus materiel to an employee, or near relative of such employee, of the Materiel Management unit or of the unit originating any excess materiel, including the authority to approve sale of a University-owned vehicle to the principal driver of such vehicle or a near relative of such employee. This authority may not be redelegated.
4. Donating the surplus materiel: to donate surplus materiel to educational institutions, other governmental bodies, or non-profit organizations when it is determined that the market value of the excess materiel is below the costs required for handling, record keeping, storage, and other costs associated with trade or sale. This authority may be delegated to the Director, Materiel Management. Materiel which may be donated includes:
i. Laboratory furniture, fixtures, equipment and supplies
ii. Office furniture, fixtures, equipment and supplies
iii. Residential furniture, fixtures, equipment and supplies
iv. Food service furniture, equipment, fixtures and supplies
v. Audio/visual equipment and supplies
vi. Health and safety furniture, equipment and supplies
vii. Recreation equipment, toys, games, sporting and athletic goods
Note: The University may not calculate public relations benefits in connection with a donation where materiel can be sold at greater financial advantage to the University.

This authority to approve sale of excess material
to an employee, or near relative of such employee, of the Materiel Management
unit or of the unit originating any excess material, or the sale of a
University-owned vehicle to the principal driver of such vehicle or near
relative of such employee, may not be redelegated. Other provisions of this delegation may be redelegated. Redelegation should align authority with
effective organizational assignments of responsibility. Any redelegation of this authority must be in writing and must
be at least as restrictive as this delegation.

Excess property: Property that has no further value to the owning unit but may have value to another unit on campus.
Surplus property: Property that has no further value to any unit on campus but is still useful.
Obsolete property: Property that has no known utility, due either to technological development, wear and tear, or damage. Obsolete property may be salvaged, scrapped, or recycled.
Near relative: Spouse,
child, parent, brother, sister, grandparent, grandchild, nephew, niece, aunt,
uncle, first cousin, son-in-law, daughter-in-law, father-in-law, mother-in-law,
brother-in-law, sister-in-law, and step-relatives in the same relationship.
III. “Supersedes” Notification
This delegation of authority supersedes delegation
Chancellor Stevens to
Vice Chancellor, Finance, Planning and Administration, dated 10/19/87.
